After the Parliament abolished triple talaq on Tuesday, PM Narendra Modi termed it as victory of gender justice which will further equality in society.

"An archaic and medieval practice has finally been confined to the dustbin of history! Parliament abolishes Triple Talaq and corrects a historical wrong done to Muslim women. This is a victory of gender justice and will further equality in society. India rejoices today!" PM Narendra Modi said in a series of tweets.

He also thanked all parties and MPs who have supported the passage of The Muslim Women (Protection of Rights on Marriage) Bill, 2019 in both Houses of Parliament. "They have risen to the occasion and this step of theirs will forever be remembered in India’s history," he said.


PM Modi said this was an occasion to salute the remarkable courage of those Muslim women who have suffered great wrongs just due to the practice of triple talaq. "The abolition of Triple Talaq will contribute to women empowerment and give women the dignity they deserve in our society," he further tweeted.

The parliament on Tuesday approved the bill that makes instant triple talaq a criminal offence, after the contentious legislation was passed by Rajya Sabha following non-aligned BJD extending support and NDA constituents JD-U and AIADMK walking out.

Lok Sabha had passed the Muslim Women (Protection of Rights on Marriage) Bill last week and with Rajya Sabha now approving it, the practice of instant divorce by Muslim men will be punishable by jail term of up to three years.

The Upper House passed the bill by 99 votes in favour and 84 against it.

It earlier rejected an opposition sponsored motion to send the bill to a Rajya Sabha Select Committee with 100 votes against it as compared to 84 in favour.

The Muslim Women (Protection of Rights on Marriage) Bill will now go to President Ram Nath Kovind for his assent. Once the triple talaq bill gets assent of the President and notified by the government, it will replace the triple talaq ordinance of promulgated last in February.

After the Rajya Sabha passed the triple talaq bill on Tuesday, Union Minister of Law & Justice Ravi Shankar Prasad said that it was the beginning of a transforming India and that both the Houses - Lok Sabha and Rajya Sabha - have given justice to Muslim women.

"A historic day when the Rajya Sabha passed the #TripleTalaq Bill, earlier passed by Lok Sabha.
Govt of PM @narendramodi has fulfilled its commitment by giving justice to Muslim women. No more Talaq-Talaq-Talaq!" he tweeted.

The Parliament on Tuesday approved the bill that makes instant triple talaq a criminal offence, after the contentious legislation was passed by Rajya Sabha following non-aligned BJD extending support and NDA constituents JD-U and AIADMK walking out.

The Muslim Women (Protection of Rights on Marriage) Bill will now go to President Ram Nath Kovind for his approval. Once the triple talaq bill gets assent of the President and notified by the government, it will replace the triple talaq ordinance of promulgated last in February.

Replying to a four-and-half-hour debate on the Bill, Law Minister Ravi Shankar Prasad cited jail provisions in the legislation that ban dowry and multiple marriages by Hindu men to justify the three-year jail term for Muslim men practices triple talaq.

To Leader of the Opposition Ghulam Nabi Azad, who termed the bill as a politically motivated move to destroy Muslim households with domestic fights, the minister said the Congress leader should think of why his party could never win majority following the peak of 400-plus seats it won in 1984.

He saw the 1986 Shah Bano case, where the Congress did not stick its neck out to support women rights, as the main reason for the downfall of the party.

The law, he said, was not being brought due to the Supreme Court ruling of 2017 declaring talaq-e-biddat, commonly referred to as instant triple talaq, unconstitutional.

"I am a minister of Narendra Modi government and not Rajiv Gandhi government," he said citing the Shah Bano case of 1986.

He said he cannot leave in lurch women who have been divorced by triple talaq via WhatsApp or other such means.

When Muslim world is trying to reform, why can't a democracy do the same, he said.

Trying to shed anti-Muslim image, he said his party gave the nation a President from the same community.

On opposition charge of targeting Muslims, he said BJP may be getting a little less votes from the community but it considers them very much a part of the country and works on the principle of 'sabka saath, sabka vikas, sabka vishwas'.

Ravi Shankar Prasad said the bill should not be seen through a political prism as it is a matter of humanity, woman empowerment and gender equality.

"More than 20 Islamic nations have regulated triple talaq," he said.

Ghulam Nabi Azad said the opposition has been forced to vote against the bill after the government did not accept their demand to send it to a select committee and make triple talaq a civil offence.

The Triple Talaq bill could not make it through the Upper House earlier this year during the first term of Prime Minister Narendra Modi's government, although it was passed by Lok Sabha.

The Bill was again passed by the Lok Sabha last week amid a walkout by several opposition parties including the Congress and the Trinamool Congress.

The opposition parties say in its current form, the proposed law could be misused to harass Muslims and wanted it to be reviewed by a parliamentary committee.

With voting mostly in favour, the triple talaq bill was on Thursday passed in Lok Sabha. The Congress staged a walkout as a protest as the Muslim Women (Protection of Rights on Marriage) Bill, 2019 was passed with the most number of voice votes in favour of the legislation. Earlier, Janata Dal (United) and Trinamool Congress (TMC) MPs, too, had staged a walkout in protest against the bill criminalising the instant divorce.

Meanwhile, the Parliament session has been extended till August 7, announced Lok Sabha Speaker Om Birla.

Lok Sabha on Thursday took up for consideration the contentious bill to ban and make the practice of instant triple talaq illegal, with up to three years in jail for the husband.

While moving the triple talaq bill for consideration, Union Law Minister Ravi Shankar Prasad said that the legislation was needed for gender equality and justice since, he argued, Muslim women are being divorced by "talaq-e-biddat" despite the August 2017 Supreme Court verdict, striking down the instant divorce.

He said, since January 2017, as many as 574 triple talaq cases and since the Supreme Court order, more than 300 such cases were reported by the media. "There have been 345 cases of triple talaq after the judgment till July 24. Should we leave these women on roads?" he said, later adding, "I am a minister in the Narendra Modi government, not the Rajiv Gandhi government."

He said the Supreme Court had noted that 20 Islamic countries including Pakistan, Afghanistan, Malaysia, Indonesia, Jordan, Egypt and Tunisia had outlawed Triple Talaq. And if they could do it, he asked, why it cannot be done in India which is a secular country?

"The Supreme Court has said that Triple Talaq is arbitrary and unconstitutional and asked Parliament to make a law. When we come up with a law, it is opposed. What should our Muslim women do in this situation? Should our Muslim sisters be left [in this situation]?" asked Ravi Shankar Prasad, adding, "The Indian Constitution is equal for all daughters. So the bill is needed."



During the debate proceedings on triple talaq bill, the Bharatiya Janata Party (BJP) ally Janata Dal (United) opposed the triple talaq bill and walked out, saying there was a need to create public awareness on the issue with the help of Muslim community leaders.

JD(U) MP Rajiv Ranjan Singh said his party believed the triple talaq bill would cause harm to the society. "The Bill will produce a different feeling in the society because no one wants that there should be differences in the relationship between wife and husband," he said.

The Trinamool Congress (TMC) and the Congress MPs also staged a walkout to protest against the triple talaq bill.

During the arguments and suggestions, Congress Kishanganj MP Mohammad Jawed opposed the triple talaq bill and said that the government should bring "laws for separated women of all communities" and not just Muslims.

"The Bill which has been tabled is another way to jail Muslims... I oppose this Bill and request the minister to send this Bill to the standing committee for review and make laws for separated women of all communities, not just Muslims," Jawed said in Lok Sabha.

Asserting that the triple talaq bill was in "violation of Article 14 of the Constitution as it discriminates between Muslim women and women of other religion", Jawed said, "Section 498 (A) of the Indian Penal Code; Domestic Violence Act and Dowry Prohibition Act already applied to Muslims too. Therefore, there is no need for having an additional law to protect only Muslim women."

In a major political win for the Narendra Modi government, the triple talaq bill today cleared Rajya Sabha hurdle. Put to vote after a lengthy debate, the triple talaq bill was passed in the Rajya Sabha with 99 to 84 votes.

The Muslim Women (Protection of Rights on Marriage) Bill will now go to President Ram Nath Kovind for his assent. Once the triple talaq bill gets assent of the President and notified by the government, it will replace the triple talaq ordinance of promulgated last in February.

The triple talaq bill has been a bone of contention between the Narendra Modi government and the Opposition since December 2017, when the government first tabled the legislation in the Lok Sabha. The bill followed a Supreme Court judgment in August that year.

The Supreme Court had declared the practice of instant triple talaq unconstitutional and a divorce pronounced by uttering talaq three times in one sitting void and illegal.

The triple talaq bill of the previous Narendra Modi government lapsed with the dissolution of the Lok Sabha upon completion of its tenure. The Rajya Sabha had not approved the bill back then.

It was the first draft legisltation that the Narendra Modi 2.0 cabinet passed after being voted back to power in the 2019 Lok Sabha election. The triple talaq bill was introduced in the Lok Sabha and passed by the house last week. The government did not face much trouble for pushing the triple talaq bill in the Lok Sabha, where it enjoys comfortable majority.

The government tabled the triple talaq bill today in the Rajya Sabha, where the Modi government needed strategic floor management to get approval of the upper house of Parliament. The ruling NDA does not have a majority of its own in the Rajya Sabha.


1. Number equation before triple talaq vote :

NDA constituent, the Janata Dal (United) opposed the triple talaq bill. This brought down the strength of the NDA from 113 to 107.

There are three current vacancies in the Rajya Sabha bringing down its total strength to 242. The JDU abstained during voting on the triple talaq bill. The Telangana Rashtra Samiti also stayed away during voting. This brought down the strenght further to 236.

At least 14 members including Arun Jaitley of the BJP, Oscar Fernandes of the Congress, and Sharad Pawar and Praful Patel of the NCP were absent in the Rajya Sabha. This bring down the effective strength of the Rajya Sabha to 216.

The government required only 109 to get the triple talaq bill passed. The Biju Janata Dal extended support to the NDA on the triple talaq bill. This pushed the NDA-plus' strength in the Rajya Sabha to 113 MPs on the triple talaq bill.


2. What actually happened :

In the end, both sides -- the treasury as well as the Opposition -- polled less than expected number of votes. For the ruling alliance, the AIADMK and abstained JDU. Among non-NDA non-UPA parties, the TRS did not take part in voting.

The AIADMK's decision to walk out ahead of voting on the triple talaq bill came late but it went in favour of the government. The AIADMK has 11 MPs in the Rajya Sabha. This explains reduction in number of votes polled in support of the triple talaq bill.

Several members of the Congress, the NCP, the Samajwadi Party too did not participate in the voting on the triple talaq bill. This translated into lower vote count on the Opposition side, which enjoys majority in the upper house.
